A legal disclaimer

These Terms of Service ("Terms") govern your use of the services provided by Autumn & Evergreen CO aka A&E CO ("we," "us," or "our") for porch decorating services. By engaging with our services, you agree to be bound by these Terms.

1. Description of Services

We offer a range of porch decorating services, including design consultation, installation of pumpkins, bales, stalks, and rug/mat pairing. Removal is NOT included in package prices and is available for additional cost. Any other potential related services will require a separate service agreement or work order. Unless otherwise agreed to, services are limited to packages listed with design, delivery, and set up.

Removal: We will remove those items originally delivered/installed, with the exception of rotted materials. We will NOT remove rotted materials, carved pumpkins, or any items not previously delivered by A&E CO.

2. Scope of Work

The specific services to be provided, including design details, materials, timelines, and payment are outlined/determined by your order form. We will provide advice and consultation based on photos submitted, if requested. If you do not request a consultation, we will design and install the display with our creative discretion. Please be clear about any areas you specifically do or do not want decorated before install date. We will clear the display area of unnecessary dirt and debris after install. We will also pre-treat pumpkins and gourds but do NOT guarantee damage from squirrels or other animals.

3. Client Responsibilities

You agree to provide us with accurate information about your porch and any specific requirements or preferences you may have for the decorating project. You are responsible for ensuring clear access to the porch area for the duration of the project, including clearing any obstructions, making arrangements for pet safety, and notifying us of any potential hazards.

Clients are responsible for loss or damage to display after install, whether caused by misuse, vandalism, weather, animals, or theft.

4. Payment Terms

The fees for our services are detailed on our website. Payments are due according to the schedule provided: 50% deposit due in order to reserve/book install and 50% due day of delivery. We cannot accept late payments or provide refunds. If you would like to transfer your booking to another address BEFORE install, we require 24 hour notice. Install may be delayed if the new address is outside our work zone for the requested date. Checks are accepted FOR DEPOSITS ONLY, unless otherwise arranged. There is a $50 fee for any returned check.

5. Property and Materials

All items, materials, and equipment provided by us for the purpose of fulfilling the decorating services remain our property until full payment is received. You agree to take reasonable care of the materials while on your property. In the event of damage to decorations or materials, we are not responsible.

6. Warranty and Guarantees

We strive to provide high-quality services and decorations. We will address any issues or concerns regarding the quality of the services within a reasonable timeframe after completion (up to one week). Due to the natural materials utilized, A & E cannot guarantee specific timelines for display longevity; weather, display placement, and your location are factors out of our control.

7. Limitation of Liability

We will not be held liable for any damages or losses arising from circumstances beyond our reasonable control, including but not limited to weather conditions, natural disasters, or other acts of nature. Our liability for any claim related to our services will be limited to the amount paid for the services.

We are not liable for damages arising from pre-existing conditions, structural issues, or circumstances beyond our control. Clients agree to hold harmless Autumn & Evergreen CO from any claims, damages, or liabilities resulting fro the use of our services.

8. Intellectual Property

Any custom designs or creative works developed by us for your porch decorating project are our intellectual property. You may not reproduce, distribute, or modify these designs without our express written consent. Any images shared via social media must tag our official accounts.

9. Governing Law

These Terms and any disputes arising from them will be governed by the laws of the State of Colorado.

10. Dispute Resolution

Any disputes arising from these Terms or our services will be resolved through good-faith negotiation.

11. Changes to Terms

We reserve the right to update or modify these Terms at any time. Any changes will be effective upon posting the updated Terms on our website or providing notice to you.
